If your com\u00adpa\u00adny purcha\u00adses, uses, packa\u00adges, imports, or exports goods, semi-finis\u00adhed pro\u00adducts, or agri-food pro\u00adducts, the\u00adre is a Euro\u00adpean regu\u00adla\u00adto\u00adry shift that you abso\u00adlut\u00ade\u00adly can\u00adnot igno\u00adre: the ent\u00adry into force of the new Euro\u00adpean Pack\u00ada\u00adging and Pack\u00ada\u00adging Was\u00adte Regu\u00adla\u00adti\u00adon (PPWR \u2014 Regu\u00adla\u00adti\u00adon EU 2025\/40<\/b>).<\/span><\/p>\n

Unli\u00adke the old direc\u00adti\u00adves, the PPWR is a direct\u00adly appli\u00adca\u00adble Regu\u00adla\u00adti\u00adon<\/b>. From August 12, 2026<\/b>, it will beco\u00adme the sin\u00adgle law throug\u00adhout the EU, repe\u00adal\u00ading Direc\u00adti\u00adve 94\/62\/EC and thus brea\u00adking down old natio\u00adnal frag\u00admen\u00adta\u00adti\u00adons, while intro\u00addu\u00adcing very strict stan\u00addards and hea\u00advy legal respon\u00adsi\u00adbi\u00adli\u00adties for tho\u00adse pla\u00adcing goods on the Euro\u00adpean mar\u00adket. (Ger\u00adma\u00adny, which alre\u00ada\u00addy moni\u00adto\u00adred strict\u00adly through the LUCID<\/b> regis\u00adter, is alre\u00ada\u00addy adap\u00adting its con\u00adtrol sys\u00adtems.) <\/span><\/p>\n

What chan\u00adges con\u00adcre\u00adte\u00adly com\u00adpared to the past and what are the main risks?<\/span><\/p>\n

    \n
  1. The Decla\u00adra\u00adti\u00adon of Con\u00adfor\u00admi\u00adty beco\u00admes man\u00adda\u00adto\u00adry:<\/b> Simp\u00adle gene\u00adric tech\u00adni\u00adcal data sheets will no lon\u00adger be enough. Every packa\u00adge must be accom\u00adpa\u00adnied by a for\u00admal Decla\u00adra\u00adti\u00adon of Con\u00adfor\u00admi\u00adty issued by the manu\u00adfac\u00adtu\u00adrer, based on tech\u00adni\u00adcal docu\u00admen\u00adta\u00adti\u00adon and labo\u00adra\u00adto\u00adry tests cer\u00adti\u00adfy\u00ading eco-design and com\u00adpli\u00adance with limits on harmful sub\u00ads\u00adtances. This decla\u00adra\u00adti\u00adon must be reques\u00adted and che\u00adcked by importers. <\/span><\/li>\n
  2. The \u201cban\u201d on PFAS in the food sec\u00adtor:<\/b> From August 12, 2026, a ban (with micro\u00adsco\u00adpic limits) kicks in for PFAS sub\u00ads\u00adtances (so-cal\u00adled \u201cfore\u00adver che\u00admi\u00adcals\u201d) in pack\u00ada\u00adging in cont\u00adact with food. Many grease\u00adpro\u00adof wraps, lami\u00adna\u00adted papers, or trays used in agri-food exports will have to be repla\u00adced. Importers will demand writ\u00adten cer\u00adti\u00adfi\u00adca\u00adti\u00adons from sup\u00adpli\u00aders befo\u00adre accep\u00adting goods. <\/span><\/li>\n
  3. New obli\u00adga\u00adti\u00adons for \u201cmanu\u00adfac\u00adtu\u00adr\u00aders\u201d and e\u2011commerce:<\/b> If you sell by app\u00adly\u00ading your name or trade\u00admark, or if you sell direct\u00adly to final con\u00adsu\u00admers via e\u2011commerce, you are legal\u00adly con\u00adside\u00adred the \u201cPro\u00addu\u00adcer.\u201d<\/span><\/li>\n
  4. Logi\u00adstics and reu\u00adse quo\u00adtas:<\/b> For B2B ship\u00adments (pal\u00adlets, cra\u00adtes, strap\u00adping, drums), man\u00adda\u00adto\u00adry reu\u00adse quo\u00adtas are arri\u00adving. Tho\u00adse trans\u00adport\u00ading goods bet\u00adween dif\u00adfe\u00adrent sites or con\u00ads\u00adtruc\u00adtion sites of the same com\u00adpa\u00adny must gua\u00adran\u00adtee a 100% reu\u00adse quo\u00adta. <\/span><\/li>\n<\/ol>\n

    Com\u00admer\u00adcial risks:<\/b> If the pack\u00ada\u00adging is not com\u00adpli\u00adant or tech\u00adni\u00adcal docu\u00admen\u00adta\u00adti\u00adon is miss\u00ading, the goods may be con\u00adside\u00adred non-mar\u00adke\u00adta\u00adble<\/b>, resul\u00adting in bor\u00adder blocks, rejec\u00adted ship\u00adments, claims for dama\u00adges, and hea\u00advy finan\u00adcial pen\u00adal\u00adties.<\/span><\/p>\n

    Why do you need legal advice and a legal review of con\u00adtracts?<\/b><\/span><\/p>\n
