In its recent\u00adly published decis\u00adi\u00adon V ZR 162\/25, the Ger\u00adman Fede\u00adral Court of Jus\u00adti\u00adce (Bun\u00addes\u00adge\u00adrichts\u00adhof \u2013 BGH) cla\u00adri\u00adfied the con\u00addi\u00adti\u00adons under which an apart\u00adment owner may obtain appr\u00adoval to install an air-con\u00addi\u00adtio\u00adning sys\u00adtem with an exter\u00adnal unit on their bal\u00adc\u00ado\u00adny. The decis\u00adi\u00adon con\u00adcerns, in par\u00adti\u00adcu\u00adlar, mul\u00adti-unit resi\u00adden\u00adti\u00adal buil\u00addings and estab\u00adlishes that, in prin\u00adci\u00adple, an indi\u00advi\u00addu\u00adal owner may assert a right to install such a sys\u00adtem against the con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adon, pro\u00advi\u00added that the instal\u00adla\u00adti\u00adon does not exces\u00adsi\u00adve\u00adly inter\u00adfe\u00adre with the rights of the other owners.<\/p>\n

The prin\u00adci\u00adple estab\u00adlished by the BGH<\/h4>\n

Accor\u00adding to the BGH, an apart\u00adment owner may request the instal\u00adla\u00adti\u00adon of an air\u00adcon\u00addi\u00adtio\u00adning sys\u00adtem with an exter\u00adnal unit on their bal\u00adc\u00ado\u00adny. Whe\u00adre the rele\u00advant requi\u00adre\u00adments are met, the con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adon can\u00adnot oppo\u00adse the instal\u00adla\u00adti\u00adon wit\u00adhout signi\u00adfi\u00adcant reasons. The rights and inte\u00adrests of the other owners must nevert\u00adhel\u00adess be ade\u00adqua\u00adte\u00adly pro\u00adtec\u00adted. The instal\u00adla\u00adti\u00adon must not result in an exces\u00adsi\u00adve inter\u00adfe\u00adrence with their rights or inte\u00adrests. A par\u00adti\u00adcu\u00adlar\u00adly rele\u00advant aspect of the decis\u00adi\u00adon con\u00adcerns noi\u00adse emis\u00adsi\u00adons. The BGH cla\u00adri\u00adfied that the mere fact that stan\u00addard com\u00admer\u00adci\u00adal\u00adly available air-con\u00addi\u00adtio\u00adning units pro\u00addu\u00adce noi\u00adse is not, in its\u00adelf, suf\u00adfi\u00adci\u00adent to jus\u00adti\u00adfy an objec\u00adtion to the instal\u00adla\u00adti\u00adon. <\/p>\n

Pri\u00ador appr\u00adoval is still requi\u00adred<\/h4>\n

The decis\u00adi\u00adon does not, howe\u00adver, estab\u00adlish a gene\u00adral right to install air-con\u00addi\u00adtio\u00adning sys\u00adtems wit\u00adhout pri\u00ador appr\u00adoval. The pro\u00adpo\u00adsed instal\u00adla\u00adti\u00adon must still be sub\u00admit\u00adted to the con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adon for appr\u00adoval. The owner con\u00adcer\u00adned must the\u00adr\u00ade\u00adfo\u00adre sub\u00admit a request tog\u00ade\u00adther with the neces\u00adsa\u00adry docu\u00admen\u00adta\u00adti\u00adon and, in par\u00adti\u00adcu\u00adlar, a quo\u00adta\u00adti\u00adon or tech\u00adni\u00adcal pro\u00adpo\u00adsal pre\u00adpared by a qua\u00adli\u00adfied spe\u00adcia\u00adlist com\u00adpa\u00adny. The reco\u00adgni\u00adti\u00adon of a right to install the sys\u00adtem does not mean that the owner may pro\u00adceed inde\u00adpendent\u00adly. Even fol\u00adlo\u00adwing the BGH decis\u00adi\u00adon, the appli\u00adca\u00adble appr\u00adoval pro\u00adce\u00addu\u00adre for mea\u00adsu\u00adres affec\u00adting com\u00admon pro\u00adper\u00adty must be fol\u00adlo\u00adwed. <\/p>\n

What does this mean for con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adons?<\/h4>\n

The decis\u00adi\u00adon makes it more dif\u00adfi\u00adcult for a con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adon to pre\u00advent the instal\u00adla\u00adti\u00adon of an air-con\u00addi\u00adtio\u00adning sys\u00adtem in the absence of signi\u00adfi\u00adcant reasons. It may the\u00adr\u00ade\u00adfo\u00adre be advi\u00adsa\u00adble to estab\u00adlish gene\u00adral cri\u00adte\u00adria for appro\u00adving such instal\u00adla\u00adti\u00adons in advan\u00adce, inclu\u00adding spe\u00adci\u00adfic: \u2022 struc\u00adtu\u00adral requi\u00adre\u00adments, such as the posi\u00adti\u00adon of the exter\u00adnal unit, for exam\u00adp\u00adle below the bal\u00adc\u00ado\u00adny rai\u00adling; \u2022 tech\u00adni\u00adcal requi\u00adre\u00adments, inclu\u00adding the use of stan\u00addard com\u00admer\u00adci\u00adal\u00adly available equip\u00adment; \u2022 orga\u00adniza\u00adtio\u00adnal requi\u00adre\u00adments, con\u00adcer\u00adning the cos\u00adts and main\u00adten\u00adan\u00adce obli\u00adga\u00adti\u00adons of the owner car\u00adry\u00ading out the instal\u00adla\u00adti\u00adon. Defi\u00adning the\u00adse requi\u00adre\u00adments in advan\u00adce can allow con\u00addo\u00admi\u00adni\u00adum owners\u2019 asso\u00adcia\u00adti\u00adons to deal with future instal\u00adla\u00adti\u00adon requests con\u00adsis\u00adt\u00adent\u00adly and effi\u00adci\u00adent\u00adly. <\/p>\n

Unaut\u00adho\u00adri\u00adzed instal\u00adla\u00adti\u00adons<\/h4>\n

The decis\u00adi\u00adon does not aut\u00adho\u00adri\u00adze instal\u00adla\u00adti\u00adons car\u00adri\u00aded out wit\u00adhout the requi\u00adred appr\u00adoval.
