The AI Act does not exempt law firms eit\u00adher. Start\u00ading from August 2, 2026, obli\u00adga\u00adti\u00adons regar\u00adding AI liter\u00adacy and, for spe\u00adci\u00adfic sce\u00adna\u00adri\u00ados pro\u00advi\u00added, trans\u00adpa\u00adren\u00adcy are inde\u00aded appli\u00adca\u00adble. The\u00adr\u00ade\u00adfo\u00adre, law firms that use arti\u00adfi\u00adci\u00adal intel\u00adli\u00adgence sys\u00adtems will also have to adopt inter\u00adnal mea\u00adsu\u00adres aimed at ensu\u00adring use that com\u00adpli\u00ades with the regu\u00adla\u00adti\u00adons, the vio\u00adla\u00adti\u00adon of which can lead to sanc\u00adtions.<\/span><\/p>\n

In par\u00adti\u00adcu\u00adlar, law firms are clas\u00adsi\u00adfied as \u201cdeploy\u00aders\u201d, i.e., pro\u00adfes\u00adsio\u00adnal users of AI sys\u00adtems deve\u00adlo\u00adped by third par\u00adties, and the\u00adr\u00ade\u00adfo\u00adre will have to adopt sui\u00adta\u00adble pro\u00adce\u00addu\u00adres to pro\u00adtect cli\u00adent data, moni\u00adtor pos\u00adsi\u00adble risks, and gua\u00adran\u00adtee a respon\u00adsi\u00adble use of the tools.<\/span><\/p>\n

First of all, it will be neces\u00adsa\u00adry to pro\u00adceed with the cen\u00adsus of the soft\u00adware used by the firm, iden\u00adti\u00adfy\u00ading all plat\u00adforms equip\u00adped with func\u00adtion\u00ada\u00adli\u00adties based on arti\u00adfi\u00adci\u00adal intel\u00adli\u00adgence, such as, for exam\u00adp\u00adle, ChatGPT or Copi\u00adlot.<\/span><\/p>\n

Once the tools have been iden\u00adti\u00adfied, it will be appro\u00adpria\u00adte to distin\u00adgu\u00adish bet\u00adween inter\u00adnal and exter\u00adnal acti\u00advi\u00adties.<\/span><\/p>\n

Inter\u00adnal acti\u00advi\u00adties can include, for exam\u00adp\u00adle, doc\u00adtri\u00adnal and juris\u00adpru\u00adden\u00adti\u00adal rese\u00adarch. They can also include the ana\u00adly\u00adsis of docu\u00adments and the pre\u00adpa\u00adra\u00adti\u00adon of con\u00adtracts and other deeds. In the\u00adse cases, the pro\u00adfes\u00adsio\u00adnal\u2019s respon\u00adsi\u00adbi\u00adli\u00adty is cen\u00adtral. The results pro\u00addu\u00adced by AI can\u00adnot be adopted auto\u00adma\u00adti\u00adcal\u00adly. Ins\u00adtead, they must under\u00adgo careful veri\u00adfi\u00adca\u00adti\u00adon and cri\u00adti\u00adcal review by the pro\u00adfes\u00adsio\u00adnal.<\/span><\/p>\n

Exter\u00adnal acti\u00advi\u00adties, on the other hand, refer to situa\u00adtions in which the use of AI comes into cont\u00adact with cli\u00adents or other sub\u00adjects. In such situa\u00adtions, trans\u00adpa\u00adren\u00adcy obli\u00adga\u00adti\u00adons take on a par\u00adti\u00adcu\u00adlar role. If a sub\u00adject inter\u00adacts direct\u00adly with an AI sys\u00adtem, they must be ade\u00adqua\u00adte\u00adly infor\u00admed of this. When con\u00adtent inten\u00added for the public is gene\u00adra\u00adted or mani\u00adpu\u00adla\u00adted by AI, it must com\u00adply with the trans\u00adpa\u00adren\u00adcy obli\u00adga\u00adti\u00adons set out in the regu\u00adla\u00adti\u00adons.<\/span><\/p>\n

Even the docu\u00adments rela\u00adting to the con\u00adfer\u00adral of the pro\u00adfes\u00adsio\u00adnal man\u00adda\u00adte may requi\u00adre spe\u00adci\u00adfic clau\u00adses aimed at regu\u00adla\u00adting the pos\u00adsi\u00adble use of AI tools, cla\u00adri\u00adfy\u00ading that their use does not ent\u00adail any exemp\u00adti\u00adon from pro\u00adfes\u00adsio\u00adnal lia\u00adbi\u00adli\u00adty.<\/p>\n

Second\u00adly, the firm will have to gua\u00adran\u00adtee an ade\u00adqua\u00adte level of AI liter\u00adacy for its staff.<\/span><\/p>\n

To this end, it will be advi\u00adsa\u00adble to docu\u00adment the trai\u00adning through a spe\u00adci\u00adfic inter\u00adnal regis\u00adter, indi\u00adca\u00adting the per\u00adson\u00adnel who have com\u00adple\u00adted the trai\u00adning, any updates car\u00adri\u00aded out, the topics and risks addres\u00adsed during the cour\u00adses, and the rele\u00advant dates.<\/span><\/p>\n

The objec\u00adti\u00adve is to ensu\u00adre that the peo\u00adp\u00adle who use AI sys\u00adtems in the per\u00adfor\u00admance of their acti\u00advi\u00adties know not only the poten\u00adti\u00adal of the tools, but also the risks con\u00adnec\u00adted to their use and the rela\u00adted regu\u00adla\u00adto\u00adry obli\u00adga\u00adti\u00adons.<\/p>\n

Par\u00adti\u00adcu\u00adlar atten\u00adti\u00adon must be paid to the pro\u00adtec\u00adtion of data and con\u00adfi\u00adden\u00adti\u00adal infor\u00adma\u00adti\u00adon of cli\u00adents. The use of AI tools can\u00adnot in fact trans\u00adla\u00adte into the indis\u00adcri\u00admi\u00adna\u00adte dis\u00adclo\u00adsure or inser\u00adti\u00adon of per\u00adso\u00adnal data or infor\u00adma\u00adti\u00adon cover\u00aded by con\u00adfi\u00adden\u00adtia\u00adli\u00adty obli\u00adga\u00adti\u00adons.<\/p>\n

Firms must the\u00adr\u00ade\u00adfo\u00adre adopt inter\u00adnal pro\u00adce\u00addu\u00adres estab\u00adli\u00adshing what infor\u00adma\u00adti\u00adon can be ente\u00adred into the various sys\u00adtems and under what cir\u00adcum\u00ads\u00adtances. The use of pro\u00adfes\u00adsio\u00adnal or cor\u00adpo\u00adra\u00adte ver\u00adsi\u00adons of AI ser\u00advices can offer grea\u00adter gua\u00adran\u00adtees in terms of data manage\u00adment, but does not eli\u00admi\u00adna\u00adte the need to car\u00adry out a pri\u00ador assess\u00adment of the tool and its set\u00adtings.<\/span><\/p>\n

The sanc\u00adtio\u00adning frame\u00adwork envi\u00adsa\u00adged by the AI Act can reach, depen\u00adding on the vio\u00adla\u00adti\u00adon and the sub\u00adject invol\u00adved, par\u00adti\u00adcu\u00adlar\u00adly high amounts, desi\u00adgned main\u00adly for lar\u00adge enti\u00adties, such as up to 15 mil\u00adli\u00adon euros or 3% of glo\u00adbal tur\u00adno\u00adver. For small and medi\u00adum-sized law firms, howe\u00adver, any mea\u00adsu\u00adres taken by the Data Pro\u00adtec\u00adtion Aut\u00adho\u00adri\u00adty or the pos\u00adsi\u00adble con\u00adse\u00adquen\u00adces from their respec\u00adti\u00adve Bar Asso\u00adcia\u00adti\u00adons for the vio\u00adla\u00adti\u00adon of pro\u00adfes\u00adsio\u00adnal and deon\u00adto\u00adlo\u00adgi\u00adcal obli\u00adga\u00adti\u00adons are also rele\u00advant.<\/span><\/p>\n

The AI Act does not aim to pro\u00adhi\u00adbit or dis\u00adcou\u00adra\u00adge the use of arti\u00adfi\u00adci\u00adal intel\u00adli\u00adgence in law firms.
