Our Italian-German law firm specializes in the European Certificate of Succession
Since 17 August 2015, Regulation (EU) No. 650/2012 has been in force, introducing the European Certificate of Succession (ECS) across all EU Member States. This certificate is intended to formally establish and certify the status of heir. Pastori & Kollegen was among the first Italian-German law firms to advise and support clients in both Italy and Germany in obtaining the European Certificate of Succession.
ECS and European Certificate of Inheritance
The ECS was created to provide a uniform framework for handling cross-border succession, taking into account the diversity of legal systems and the involvement of multiple authorities. It enables heirs, legatees, executors, and estate administrators to exercise their rights or powers related to an inheritance in another EU Member State — i.e. in a jurisdiction other than the one where the succession was originally opened.
Recognition of heir status across the EU
With the issuance of the European Certificate of Succession, heirs are able to demonstrate their legal status throughout the EU without the need for separate recognition procedures in each country. On a yearly basis, numerous families face cross-border succession issues, as either the estate or the heirs are located in different Member states. Given the the significant variations among national inheritance laws, these situations, often raise complex legal questions. The ECS significantly simplifies the process, offering a more effective solution. To ensure a more efficient handling of inheritance matters, Pastori & Kollegen collaborates closely with bilingual German notary Oliver Wedel, who is authorized to authenticate German public deeds directly in Italian. He is also empowered to issue the European Certificate of Succession, providing clients with fully legally recognized documentation.
